1. Acceptance of Terms
By using Brainberyl, you agree to these rules. If you don't agree, you can't use the service.
By accessing or using the Brainberyl website and services (collectively, the "Service"), provided by Brainberyl AI Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms").
If you are using the Service on behalf of a school, district, or other organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Services
We provide AI tools to help teachers grade papers faster. We give you a non-exclusive right to use them.
Brainberyl utilizes artificial intelligence to assist educators in grading student work ("Services"). The Service includes but is not limited to: uploading student submissions, AI-powered analysis, feedback generation, and grade recording.
- We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service.
- We may update or modify the Service at any time to improve performance or features.
3. User Accounts
Keep your password safe. You are responsible for what happens on your account.
To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during the registration process.
You are responsible for safeguarding your password. Brainberyl cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.
4. AI Grading Disclaimer
Our AI is smart, but not perfect. Always review the grades before finalizing them.
The Service utilizes advanced Artificial Intelligence (AI) models to analyze student work. While we strive for high accuracy, AI models can make errors ("hallucinations") or misinterpret context.
Brainberyl is not liable for any academic consequences resulting from reliance on unverified AI grading.
5. Subscription & Payments
We offer free and paid plans. You can cancel anytime, but we don't usually offer refunds for partial months.
Certain features of the Service are available only through a paid subscription ("Pro Plan").
- Billing: Subscription fees are billed in advance on a monthly or annual basis.
- Cancellation: You may cancel your subscription at any time. Your access will continue until the end of the current billing period.
- Refunds: Payments are generally non-refundable, except where required by law.
6. Data Responsibilities
Don't upload sensitive personal data you aren't allowed to share. We protect your data, but you own it.
You retain all rights to the data, files, and student work you upload to Brainberyl ("User Content").
By uploading User Content, you grant us a license to process that content solely for the purpose of providing the Service (e.g., generating grades). We do not sell student data or use it for advertising.

7. Termination
We can suspend your account if you break the rules (like trying to hack us).
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
8. Limitation of Liability
We provided the service 'as is'. We aren't liable for huge damages if something goes wrong, beyond what you paid us.
In no event shall Brainberyl, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
